Surgeon settles malpractice suit; more cases loom

An orthopedic surgeon facing criminal charges in two counties has settled a medical malpractice lawsuit filed against him for an undisclosed amount.

A complaint filed last year in Lucas County Common Pleas Court by Ruth and Phillip Anderson of Ottawa Lake against Dr. Jake Heiney, 40, and his former practice, Cutting Edge Orthopaedics LLC, was dismissed last week.

Chad Tuschman, who represents the Andersons, said his clients received a “very favorable” settlement, the terms of which are confidential. Dr. Heiney’s attorney could not be reached for comment.

In the lawsuit, Mrs. Anderson alleged she was left with permanent nerve damage in her left leg after Dr. Heiney performed hip replacement surgery on her Jan. 24, 2014, at Mercy St. Vincent Medical Center. As a result of the lawsuit, Dr. Heiney was charged with tampering with records, a first-degree misdemeanor, in Sylvania Municipal Court for allegedly altering Mrs. Anderson’s medical records.

In Monroe County Circuit Court, Dr. Heiney is scheduled for arraignment this morning on four counts of criminal sexual conduct for allegedly touching two female patients inappropriately at his Lambertville office. In Lucas County Common Pleas Court, he faces two counts of gross sexual imposition and one count of tampering with records for similar offenses at his Sylvania office.

He is not practicing medicine with the cases pending.
