Teen home-invasion robber sentenced to 13 years in prison

A Toledo teen who was certified to stand trial as an adult for a violent home invasion was sentenced Wednesday to 13 years in prison.

Robert Neely, Jr., 18, of the 2100 block of Elliot Avenue pleaded no contest Nov. 21 and was found guilty of attempted murder and aggravated robbery for the Aug. 28, 2016, attack on Kevin Russell, Sr., 55, at his home in the 3200 block of North Detroit Avenue.

Mr. Russell was shot multiple times and robbed of money and property by Neely and two others.

Lucas County Common Pleas Judge Linda Jennings told Neely his actions showed that he was cold, calculating, and had no regard for human life.

“Mr. Neely, you are a dangerous person,” the judge said. “You were 17 years old when you committed this offense. You went to the victim's house with the purpose of robbing him, and you took a gun with you, and once inside you struck the victim in the head.”

She said Neely stood over the victim, fired a shot, threatened to shoot him again if he didn't tell him where his property was, then shot him again and again.

“You shot him a total of three times: in the neck, in the knee, and in the arm, causing serious physical harm that he will continue to suffer from,” Judge Jennings said. “He has nerve damage to his hands, arms, leg, back, and face and will require a knee replacement.”

Jennifer Donovan, an assistant county prosecutor, told the court she was recommending concurrent sentences, but the court imposed consecutive terms of five years for attempted murder, five years for aggravated robbery, and three years for the firearm specification. Neely received credit for 272 days he already had spent in jail.

Defense attorney Jack Viren told the court Neely had a significant substance-abuse problem that likely contributed to his behavior.

Neely apologized to the victim and his family, and he asked the court for mercy, saying he wanted “to get back to my family.”
