A Sylvania woman accused of sexually abusing a 4-year-old girl and sending images of the girl via the Internet to a Florida man was ordered yesterday to refrain from contacting relatives of the victim.
Lucas County Common Pleas Judge Ruth Ann Franks expanded a no-contact order for Elissa Schuster, telling the 23-year-old woman not to make any contact with the child's guardian.
Ms. Schuster, of 6504 Cornwall Ct., is charged with one count each of pandering obscenity involving a minor, illegal use of a minor in nudity-oriented material, and rape.
Her trial is scheduled to begin Dec. 15.
During a hearing to discuss pretrial issues, J. Tracy Sniderhan, an assistant prosecutor, asked the court for the additional condition as part of Ms. Schuster's $250,000 surety bond after he learned that the defendant allegedly made a telephone call to the guardian.
In addition, Judge Franks scheduled a hearing for Dec. 2 to address any pretrial motions that could be filed, including requests to suppress evidence that police obtained in the course of their investigation.Ms. Schuster's attorney, Alan Konop, told Judge Franks that he obtained the bulk of the information from prosecutors just before yesterday's hearing and did not have the opportunity to review it. Mr. Konop said he would need additional time to review the material to determine whether any motions should be filed.
Sylvania police said Ms. Schuster sent images of the girl to John Fleming, 36, of Tampa, with whom she had developed an online relationship.
Police said she sent the pictures in hopes of obtaining something of value from Mr. Fleming, who Ms. Schuster thought was a professional football player.
Mr. Fleming was arrested Sept. 29 by Hillsborough County, Florida, detectives and charged with possession of child pornography.
