Weston mans estate sues landlord over fatal fire
BOWLING GREEN — The administrator of the estate of a Weston man who died in an apartment fire last summer has sued the owner of the apartment house for negligence.
In a complaint filed in Wood County Common Pleas Court, Abel Perez, Sr., claims the apartment where his son, Ronald Perez, lived was not equipped with working smoke detectors when a fire broke out there on July 13, 2008. He alleges owner Daniel Van Vorhis “owed a duty of care” to supply the building with working smoke detectors and comply with all applicable building, housing, health, and safety codes.
The case has been assigned to Judge Reeve Kelsey.
Ronald Perez, 45, and Jimmy White, 69, died in the fire, which displaced 28 other occupants of the Walnut Street apartment house. Investigators with the state fire marshal’s office listed the cause of the fire as undetermined, but said it was likely caused by careless smoking.
Mr. Van Vorhis said at the time that he had updated the smoke detectors in each of the apartments in June.
