Police sergeant’s charge called unsubstantiated

Allegations of misconduct filed against a Toledo police sergeant — who had previously been fired and then reinstated for making sexual comments to a convenience store employee — were found to be unsubstantiated, Chief Mike Navarre said.

A complaint was filed in late August against Sgt. Daniel Brandon after he allegedly made inappropriate comments to a woman reporting a burglary.

Chief Navarre said the Internal Affairs investigators determined that other officers did not hear the alleged remarks and that the complainant “wasn’t being totally truthful about the robbery,” which lessened her credibility.

The incident was the second in which the sergeant was accused of making inappropriate comments.

Sergeant Brandon was fired Sept. 30, 2008, after he was found to have made sexual comments to a woman, suggested use of an illegal substance, and used vulgar language.

The incidents occurred March 20, 2008, and April 6, 2008.

An arbitrator heard the sergeant’s case June 13 and ordered that he be returned to duty without back pay.

Chief Navarre said the sergeant is working a desk job on the midnight shift at the Scott Park station but is in the process of being moved back to the street.
