A South Toledo woman who said she was injured after striking a large pothole last year on South Detroit Avenue filed suit against the city of Toledo claiming negligence and reckless conduct.
Maggie Vasquez-Cromer and her husband, Joseph, claim in a lawsuit filed Tuesday in Lucas County Common Pleas Court that the city failed to properly maintain and repair its streets.
In addition, they claim the city’s Division of Streets, Bridges, and Harbor was made aware of a 5-foot pothole on South Detroit near Myers Street but failed to do anything about it.
According to the complaint, Mrs. Vasquez-Cromer was on her way to work Feb. 26, 2016, when she struck the pothole, blew out her front tire, lost control of her vehicle, traveled over three lanes of traffic, and hit a guardrail. The suit, filed by attorney Charles Boyk, seeks damages in excess of $25,000.
City Law Director Adam Loukx had not seen the complaint but said the city “places great priority on the maintenance of its roads” and attempts to respond to complaints about conditions “in an effort to maintain public safety and flow of traffic.”
